How can I sell my house in Getsemaní?

Sell property in Cartagena

Sell a house in Getsemaní Here is what changes in this sector and what to have ready before going to market.

A house has no building administration and no condominium bylaws shaping the sale, so the weight shifts onto the land itself: boundaries, lot and built area, and everything added over the years. The first task is to compare what stands today against what the deed and the registry folio describe, because extensions, added floors, pools and perimeter walls built without permits and never recorded are the most common source of trouble once a buyer applies for financing and the bank reviews the file. Also look at rights of way, shared walls, water and power connections, and structural, roof and moisture condition, which the local climate exposes quickly. With that settled you set the asking figure, tidy the garden and outdoor areas, which genuinely matter here, and arrange showings. Before publishing anything it helps to hold the deed, the registry certificate, tax receipts and any plans or permits. How long the process runs depends on the market and the price. Nisimblat Law takes care of the legal work in Colombia, from the purchase promise through the deed.

What Getsemaní is, and what changes there

Getsemani lies just outside the walls and is the old city's working-class neighborhood turned cultural quarter. What is marketed here is houses, hotels and commercial units, not apartment towers, and that single feature separates it from almost every other sector in Cartagena. The grain is small: narrow lots, continuous street frontage, two and three story buildings, courtyards behind modest doors. Many properties have been adapted into guesthouses, restaurants or bars, which makes the ground floor economically important in a way it is not in a residential tower, and makes noise, licensing and the use of neighboring buildings part of any decision. A buyer evaluating a house here is really evaluating a structure, its authorized works and what the surrounding uses will be like after dark. Sellers face a buyer pool interested in operation as much as in dwelling. Renters encounter a mix of long-term housing and lodging, unevenly distributed street by street. Whether a property may be operated commercially or for paying guests follows from its own permits and the rules over that block, confirmed for each address.

American buyer

Moving the money is not a formality. Funds leaving a US account have to enter Colombia through the regulated foreign-exchange market with a declaración de cambio, the exchange declaration, and the Banco de la República is the body that explains how the operation is recorded as foreign investment and in whose name, because whoever sends the money and whoever appears on the escritura, the deed, must be the same person or the same company. Signing from abroad has two routes that are not interchangeable: a poder, a power of attorney, granted before a Colombian consul where you live, or one granted before a notary public and then apostilled. Which one the Cartagena notaría will accept is a question for that notaría and for the Cancillería before you pay for a translation. Visas and the cédula de extranjería, the foreigner ID card, are a separate matter from the purchase and belong to Migración Colombia: buying does not stand in for the immigration process, nor the reverse. On tax, the question to settle is whether a treaty exists between Colombia and your country and what it says about rental income and about ganancia ocasional, the gain taxed on sale. Confirm that with an accountant in each country, not with the seller.
