What should a rental agreement include in Cartagena de Indias?

Rent out my property in Cartagena

Rental agreement in Cartagena de Indias Here is what changes in this sector and what to put in writing before handing the property over.

A residential rental agreement exists so both sides know in advance what happens in each foreseeable situation, which is why the valuable thing is holding the list of topics to cover before sitting down to sign. Among them: identification of the parties and the property, use restricted to housing, duration and how extension works, the method and channel of payment, how utilities and building dues are split, the agreed backing, the treatment of improvements and repairs, rules on pets, subletting and the number of residents, the attached inventory, return conditions, and grounds for early termination. The actual wording, the effect of each clause and what may validly be agreed in Colombia belong to a lawyer, not to a downloaded template. Questions worth bringing: which of my intentions carry no effect, how each side agreement gets documented, which annexes should be signed the same day. The deepest trouble comes from signing a generic form with no inventory, no cost split and no agreed way of giving notice. Nisimblat Law drafts and reviews this for clients of Dimare Collection.

What Cartagena de Indias is, and what changes there

Cartagena de Indias is the general case, the whole city, and the first useful thing to say about it is that it does not behave as one market. The walled center is a heritage asset with fixed supply; the peninsula is a dense, mature resale market of towers; the northern corridor is where construction is happening; the outlying coastal townships are land and early-stage projects. Property types run from colonial houses and commercial premises to tower apartments, houses inside gated developments, hotels and raw land, and each one carries its own paperwork, its own maintenance economics and its own buyers. The city is a Caribbean port with an airport inside it, a flight to Miami of around three hours, and a visitor economy that shapes demand in some sectors and barely touches others. Anyone deciding here benefits from narrowing the question quickly, because advice that fits one sector often misleads in the next. Where the future of a given area is part of the reasoning, it depends on the market, and any construction said to be in progress needs confirming against current documents.

Serviced lots

A serviced lot is bought differently because what you acquire is a capacity to build, not a built thing. The value sits in what the rules allow on that specific parcel and in the state of the surrounding development, not in what you see on a site visit, which looks much the same on every lot of the block. Three consequences follow. First, the folio tends to be young, since it was created by splitting a larger parent parcel, so the useful history lives in that parent folio and in how areas, roads and public land dedications were divided. Second, the developer does not vanish with the sale: if water, sewer, road or green- area works are still unbuilt, or obligaciones urbanísticas (duties owed to the city by the developer) are still outstanding, there remains a counterparty, and it is worth knowing who answers for them and against what security. Third, the asset produces nothing until it is built on, while still generating impuesto predial, development dues and the cost of watching over empty land. For a buyer abroad, a lot also means a permit process and a construction job run from Colombia, by someone authorized to sign.
