What rules should be checked before offering Getsemaní as a short-term rental?

Short-stay management in Cartagena

Short-term rental rules in Getsemaní Here is what changes in this sector and what has to be reviewed before activating the property.

Before an apartment is activated there is a prior review, and its outcome cannot be assumed; it is confirmed property by property. The building bylaws get examined, and they are the source of most surprises, because each condominium makes its own decisions about short stays, visitor circulation, use of common areas, hours, noise, pets, and front desk registration. The declared use of the property in its own documents gets examined, to learn whether it is compatible with a lodging operation. The general requirements applying to anyone offering tourist accommodation get examined, in terms of registrations, obligations, and filings, which is worth reviewing with a specialist rather than resolving by analogy with another building. And the insurance policy gets examined, since not every coverage contemplates this use. None of this is legal advice or a statement about what a given apartment may do; it is the list of what has to be verified. The expensive error is furnishing, photographing, and publishing first, then reading the bylaws after a neighbor complains.

What Getsemaní is, and what changes there

Getsemani lies just outside the walls and is the old city's working-class neighborhood turned cultural quarter. What is marketed here is houses, hotels and commercial units, not apartment towers, and that single feature separates it from almost every other sector in Cartagena. The grain is small: narrow lots, continuous street frontage, two and three story buildings, courtyards behind modest doors. Many properties have been adapted into guesthouses, restaurants or bars, which makes the ground floor economically important in a way it is not in a residential tower, and makes noise, licensing and the use of neighboring buildings part of any decision. A buyer evaluating a house here is really evaluating a structure, its authorized works and what the surrounding uses will be like after dark. Sellers face a buyer pool interested in operation as much as in dwelling. Renters encounter a mix of long-term housing and lodging, unevenly distributed street by street. Whether a property may be operated commercially or for paying guests follows from its own permits and the rules over that block, confirmed for each address.

Colombian living abroad

This is the case apart. You need no visa and no cédula de extranjería, because your document is the Colombian cédula, and that is exactly what gets neglected: check that the cédula is current and that its details match the registry, because an unrecorded change of marital status or surname stops the deed. The money, though, does come from abroad, so the transfer enters through the regulated exchange market with its declaración de cambio like anyone else's, and if you are not a Colombian tax resident that inflow may have to be registered as foreign investment with the Banco de la República: they are who to ask whether your particular case requires it. What really changes is how you file. Tax residence is not chosen, it is determined by rules, and not being a Colombian tax resident alters what is withheld from you and what you report to the DIAN, both on rent and on sale. For signing from abroad, the Colombian consulate where you live grants the poder. And the tax question is whether a treaty exists between Colombia and the country where you live and what it says about rental income and about ganancia ocasional, with an accountant in each country.
