Buying property as a foreigner in Cielo Mar Here is what changes in this sector, which kind of property fits and what to check before signing.
A foreigner can buy property in Colombia, and the hard part is not the purchase itself but getting the questions in the right order before starting. The sensible route is settling them with a lawyer in Colombia and an accountant where the buyer is resident, because the two jurisdictions touch and whatever is resolved in one has effects in the other. The questions worth raising: how the property is best held given who will use it and inherit it, how incoming funds get documented so a future exit runs clean, what tax obligations arise from owning it, how to sign remotely through a power of attorney, and what formalities such a power needs when granted abroad. None of this should be taken from a forum or from an acquaintance's experience, because every personal situation changes the answer. The direct flight between Cartagena and Miami, around three hours, makes it workable to come and sign or take delivery. Dimare Collection walks the purchase and Nisimblat Law provides the legal services in Colombia.
What Cielo Mar is, and what changes there
What sets Cielo Mar apart is that much of the buying happens before the property legally exists. Units sell off plan, and the counterparty is not an owner but a fiduciaria, a trust company, managing a patrimonio autónomo, a segregated trust estate, into which the landowner contributed the site. That changes the whole process. The first document signed is not a deed but an enrollment in the project; the money goes into a trust account rather than to a seller; and the deed is granted once the punto de equilibrio, the pre-sales break-even threshold, is reached and the building goes up, so in the early stage there is no unit folio to certify because none has been opened. Ask for the trust agreement and ask what happens if that threshold is never reached, who returns the money and on what terms. Who decides changes too: the governing document is the permit issued by the curadurÃa urbana, the private licensing office, and the condominium bylaws are still unregistered, so you read a draft. Utilities may be run by private operators belonging to the development itself, meaning the supply relationship does not start with the city water company.

Canadian buyer
The money usually leaves in Canadian dollars and arrives converted, so the transfer crosses two banks and a currency conversion before it enters the Colombian exchange market with its declaración de cambio. Ask your bank in writing which beneficiary details it requires, and ask the Banco de la República how registration of foreign investment works, because a transfer that arrives wrongly recorded is fixed afterwards and at a cost. The power of attorney for signing from abroad is granted either before a Colombian consul or before a notary in your province and then apostilled; since the apostille depends on the country being party to the Hague Convention, the CancillerÃa is who confirms which seal your document needs and which provincial office issues it. Visas and the cédula de extranjerÃa are a question for Migración Colombia, not something to infer from what another buyer told you. The tax question to settle is whether a treaty exists between Colombia and your country and what it says about rental income and about ganancia ocasional, and it is settled with an accountant in each country before you sign the promesa de compraventa, not in next year's return.
