What documents do I need to buy in Morros?

Buy property in Cartagena

Documents to buy property in Morros Here is what changes in this sector, which kind of property fits and what to check before signing.

The question about documents has two sides worth separating. One is which papers belong to the property and have to be examined before anyone commits: the chain of ownership, the condominium clearance certificate, the standing of the property tax, the building bylaws, and proof of who actually holds authority to sell. The other side is what the buyer contributes, which varies with who is buying, with what funds, and from where. This is not the same as inspecting the property physically, nor the same as examining a project under construction: here the legal position of the asset and of both parties is what gets verified. The sensible move is not to assemble the list alone or lift it off a forum, because it depends on the case, and a missing item surfaces exactly when dates have already been committed. Worth asking a lawyer: what this particular transaction requires, in what order to obtain it, and which documents expire. In Cartagena the legal services are provided by Nisimblat Law, with Dimare Collection coordinating with the seller.

What Morros is, and what changes there

What you buy in Morros is not land but a private unit created by subdividing a single folio matriz, the parent registry record, and that changes the file. The chain of title on the land was settled once by the builder; what remains to review is the registered reglamento de propiedad horizontal, the condominium bylaws, any acta de asamblea, owners' meeting minutes, that amended them, and the coeficiente de copropiedad, the ownership share assigned to the unit, which governs both voting and billing. The counterparty differs from the undeveloped north as well: usually an individual owner living outside Cartagena, so closing depends on a power of attorney from that person, on a spouse's consent where it applies, and on the paz y salvo, a no-arrears certificate signed by the building manager, a document that does not even exist for rural land. Decisions here belong to the owners' assembly and the manager it appoints, not to a public office; the District and the curaduría urbana, the private licensing office, had their say when the tower was permitted. Internal infrastructure, from pumping to the generator and security, is private and funded by the budget that same assembly approves, so the minutes describe the property better than any tour.

Buyer from Bogotá

The mortgage comes from a Colombian bank, against a local credit history, not from a bank abroad and not from the seller: the bank pulls your record from the centrales de riesgo, the credit bureaus, asks for proof of income and orders its own avalúo, the appraisal, and title study. Whoever answers for the approval is the bank's mortgage department, not the sales office. Ask in writing for the approval letter and the disbursement instructions, because each disbursement is supported by a different document: first the promesa de compraventa, the purchase promise, and then the escritura once registered with the mortgage recorded on it. The money does not enter through the regulated exchange market and there is no foreign investment to register with the Banco de la República; what does have to be assembled is proof of the source of funds, which is a separate matter and is requested by the bank and the notaría. You can sign in person, so no poder and no apostille are needed, yet you manage the property from another city: settle who receives it, who pays the predial, the property tax, and the building fee, and who issues the paz y salvo, the clearance certificate, before each step. What sets you apart from a Medellín buyer is not the law, which is the same, but the channel: your file is usually studied in the city where you live. Tax questions go to the DIAN and to an accountant.
