Rent out my property in Cartagena
Rental agreement in Los Morros Here is what changes in this sector and what to put in writing before handing the property over.
A residential rental agreement exists so both sides know in advance what happens in each foreseeable situation, which is why the valuable thing is holding the list of topics to cover before sitting down to sign. Among them: identification of the parties and the property, use restricted to housing, duration and how extension works, the method and channel of payment, how utilities and building dues are split, the agreed backing, the treatment of improvements and repairs, rules on pets, subletting and the number of residents, the attached inventory, return conditions, and grounds for early termination. The actual wording, the effect of each clause and what may validly be agreed in Colombia belong to a lawyer, not to a downloaded template. Questions worth bringing: which of my intentions carry no effect, how each side agreement gets documented, which annexes should be signed the same day. The deepest trouble comes from signing a generic form with no inventory, no cost split and no agreed way of giving notice. Nisimblat Law drafts and reviews this for clients of Dimare Collection.
What Los Morros is, and what changes there
Los Morros refers to the first consolidated stretch of the northern corridor, the part that already feels finished: gated complexes of towers facing the beach along the Anillo Vial, each with its own amenities and its own internal services. Almost everything here is condominium apartment rather than house or land, and a large share was bought as a second home, which gives the sector a seasonal rhythm that a year-round neighborhood does not have. Its advantage over the stretches further north is that the fabric exists: neighboring buildings are already built, so the view and the sunlight a unit has today are unlikely to change, and the drive to the airport is short. Its limitation is dependence on a single road and on amenities located inside each complex rather than on the street. For a buyer the decisive documents belong to the building, not to the land: the bylaws, the assembly minutes, the dues and the reserve fund. Sellers compete directly with neighboring towers of similar age. For renters, whether a given complex allows stays by the night is decided by its own rules and verified building by building.

Mexican buyer
Two currencies are called pesos in this transaction, so always say which one you mean: the contract is signed in Colombian pesos while the money leaves in Mexican pesos. The transfer is converted, enters through the regulated exchange market with its declaración de cambio and is registered as foreign investment with the Banco de la República, which is who to ask about how and in whose name. The poder for signing from abroad is granted before a Colombian consul in the city where you live or before a notario público and then apostilled, and which of the two the Cartagena notarÃa wants is confirmed with that notarÃa and with the CancillerÃa before you fly anywhere to sign. Visa rules and the cédula de extranjerÃa are not the same for every nationality and belong to Migración Colombia: entering without a visa to visit the city and settling in it are two different situations. The tax question to settle with an accountant in each country is whether a treaty exists between Colombia and your country and what it says about rental income and about ganancia ocasional.
