House in a gated community in Cielo Mar: what you are actually buying

In Cielo Mar a house inside a gated community is either the ordinary product or a rarity, and that changes the question. Where it exists, you are not buying a house: you are buying a private unit under propiedad horizontal, with dues, owners' meetings and bylaws that decide your façade colour.

The plot the house sits on is usually private area, but the internal road, the pavement, the gatehouse, the pool and sometimes the front garden are common property. Three money consequences follow: there are dues even with no lift; façade, height and extension limits live in the bylaws rather than the POT; and any work needs a District permit plus the copropiedad's authorisation. Where the sector is all towers, or all lots and standalone houses, the question moves: the first thing to settle is no longer the bylaws but whether what you are shown sits under propiedad horizontal at all or is an independent property. You cannot tell from the street.

What is specific to Cielo Mar

Morros continued northward: newer development and less established street retail. Recently built towers with undeveloped lots still sitting between them. It depends entirely on the Anillo Vial; groceries and school are not walkable.

  • what has been permitted on the neighbouring lot, because a new tower next door changes the view and the sunlight you paid for
  • how drinking water arrives and where the sewage goes, which along this northern stretch is not always the public network
  • whether the building permit is current and matches what the sales office is offering

What to verify, step by step

  1. Order the certificate of title and confirm whether the house has its own folio under a condominium regime or is an independent property. It is settled online from abroad and decides everything else.
  2. If it is under the regime, request the registered bylaws and read the chapter on façades, enclosures, heights and extensions before planning work.
  3. Request the site plan and ask what counts as private area: the front garden, the boundary wall and the parking space are the three points buyers get wrong.
  4. Ask the manager for the dues, the reserve fund and any approved special assessments; in a staged master community, whether master dues are billed on top of the complex's.
  5. Check the POT for the use and rules on the property in Cielo Mar, because bylaws restrict but never extend what the District allows, and ask the curaduría for the permit covering any added extension.

Mistakes that cost money

  • Buying with plans to extend. An extension needs a permit plus the copropiedad's authorisation, and many bylaws forbid it outright.
  • Assuming there are no dues because there is no tower and no lift. The internal road, the gatehouse and the pool still have to be funded.
  • Hunting for a community house where the market is towers or land. There, what sits under no condominium regime gets presented as a community, and the regime is confirmed at the registry, not at the gatehouse.

Frequently asked questions

Do I pay dues if I buy a house rather than an apartment?
If the house is under a condominium regime, yes. The bylaws and the certificate of title confirm it, not the type of dwelling.
What if there is hardly any gated-community housing in Cielo Mar?
That happens in tower sectors and in lot-and-standalone-house sectors, and saying so beats forcing the comparison: what you compare is the product that does exist there. What decides it in Cielo Mar is this: what has been permitted on the neighbouring lot, because a new tower next door changes the view and the sunlight you paid for; how drinking water arrives and where the sewage goes, which along this northern stretch is not always the public network and whether the building permit is current and matches what the sales office is offering.
Is the plot under the house mine?
It is usually private area, but the front garden, the road and the boundary wall may not be. Ask for the site plan and the deed.
