Mortgage Options for Foreign Buyers in Bay Harbor Islands: Questions to Ask Lenders

A buyer with no U.S. credit history is not shut out of the mortgage market, but enters through a different door. And in Bay Harbor Islands there is an extra filter that catches many by surprise: the building itself.

A lender measures risk with tools a foreign buyer does not feed: a domestic credit score, domestic tax returns and a domestic payment history. Without those it substitutes other signals, and every substitution has a price. But there is a second filter that does not depend on you: many lenders will not finance certain buildings, because of the share of units rented out, open litigation or the state of the reserves. A deal approved on the buyer can still fail on the building.

Bay Harbor Islands forces a check that exists nowhere else: the address decides which rulebook applies, because the town administers two islands with separate zoning, and what is permitted on one is not authorized on the other. Buyers abroad sometimes sign off a floor plan without knowing which side they are on, then learn that the use, the height or the rental they assumed belongs to the other shore. The second distinguishing feature is the counterparty: canal-front houses and buildings with very few units dominate here, so across the table there is rarely a professional manager with an orderly archive, but an individual owner, a family estate, or a tiny association governed among neighbors whose minutes may be a notebook. That stretches out document delivery. Ask the town exactly what that island and that parcel allow; ask your closing attorney who issues the estoppel when the association has no manager; and, if there is a dock, ask what marine construction approval the town requires and what the county and state authorities require on top of it.

What is specific to Bay Harbor Islands

Two small bay islands, one residential and one commercial, joined by Kane Concourse. Low-rise buildings with few units, many of them recent, and single-family homes on canals. You pass through here to go from Bal Harbour to the mainland; no rail.

  • which of the two islands the property is on, because permitted use differs
  • whether the building has few units, which concentrates the cost of any special assessment
  • canal access and depth if the house has a dock

What to verify, step by step

  1. Ask each lender whether it has a programme for foreign nationals without local credit history, because not all do and it is not advertised.
  2. Request the exact document list in writing before starting: bank letter, statements, accountant's reference, passport.
  3. Ask whether it accepts income and documents in your currency and language, or requires sworn translation.
  4. Before falling in love with an unit, ask the lender whether that specific building is financeable for them.
  5. Compare at least three lenders on the same property: the same profile receives different terms.
  6. Keep the pre-approval in writing and dated, and ask what would void it.

Mistakes that cost money

  • Believing a pre-approval is an approval. It is not, and the difference shows up when the lender appraises the property and reviews the building.
  • Searching for property before knowing whether there is financing and of what size.
  • Assuming that because the building has other mortgages yours will go through: each lender applies its own criteria.

Frequently asked questions

Do you need residency to apply for a mortgage?
Residency and financing are separate matters. What each lender requires is a question for the lender; immigration questions belong with an immigration attorney.
Why would a lender reject an entire building?
It usually looks at the share of units rented out, open litigation and the state of the reserves. Ask before you reserve, not after.
Can you buy in cash and finance later?
Some buyers use that route. The terms and timing are set by each lender, so it is worth asking before closing.
