Taking delivery of a beach lot in Barceloneta: what the acta has to record

Handover is the one moment when the buyer has the property in front of him and still holds something to pay or to demand. Whatever is left out of the acta that day stops being a claim and becomes a conversation.

Taking delivery of a beach lot is not signing that the keys arrived: it is recording the condition in which the property is received, the open items, and how and when they will be addressed. The acta de entrega is a private document between the parties, and its worth lies in its detail: an inventory of what is handed over, meter readings, the state of finishes and equipment, keys and remotes, and the list of observations signed by both sides. New construction adds the recibo de obra and whatever the builder has warranted; a resale adds whatever the seller undertook in the promesa de compraventa, the binding promise of sale. After handover the claim changes counterpart: it stops being a conversation with a seller or a builder and becomes a contractual matter, which is where it starts to matter whether there are proceedings open against the person who sold to you.

A beach lot is bought differently because the first question is not what you may build but whether a private owner ever existed. Along the coastal strip you find land that could lawfully be granted, land that never left the public domain, and land someone occupied and then transferred without holding the right, so the chain of title may rest on mere possession or on falsa tradición, a transfer by someone who never held registered ownership. No deed, no notaría and no lapse of time fixes that, because property in the public domain cannot be acquired by prescription. Investigating the origin of title therefore outranks everything else and comes before any other conversation. The second difference is that the object itself moves: the shoreline advances or retreats, and the area shown on the folio may not be the land that is dry today. The third is that a substantial part of the terrain is not buildable at all, between the public strip, the ronda hídrica (protected water margin) and environmental setbacks, so the usable lot is always smaller than the lot purchased, and it is worth fixing that with a survey and with the environmental authority.

What sets this sector apart is that the land comes out of the countryside and its titling is young: many parcels began as adjudicated or occupied rural land and still sit under large parent folios never split off, with boundaries described by features of the terrain and chains carrying falsa tradición, defective title that transfers possession rather than ownership, so what is sold as a lot may be an undivided share of something larger. The counterparty is not the one from the built city either: usually a village family, a holder of an adjudication, or a developer who bought to subdivide, and in the first case confirm the capacity to sell and whether any restriction flows from how the title arose. Authority shifts with the boundary: confirm first whether the land answers to the District of Cartagena or to the neighboring municipality, because that decides which office issues the land-use certificate and where a permit is filed, while environmental and coastal matters stay with the regional corporation and the maritime authority. Infrastructure is not given: road access and utility connections are negotiated and documented, never assumed.

What is specific to Barceloneta

A northern-strip township still rural in character, with a long beach and development only beginning to take shape. Large tracts of land and village housing dominate, with house and condominium developments taking form. Access is by the northern-strip highway, and getting inland depends on local roads and crossings over private land.

  • which municipality the land belongs to, because the northern strip borders Santa Catalina and land-use certificates and permits are not issued by the same authority on either side of that line
  • how the title was created, since there is adjudicated rural land and parcels carrying falsa tradición, and whether the registry folio has been split off from the parent tract
  • whether water, power and wastewater come from public networks or private solutions, and who answers for the access road to the lot

What to verify, step by step

  1. Ask for the acta template before the appointment and read it with your lawyer: anything without a field will not get written down.
  2. Walk the property with the permit and the approved drawings in hand and compare what was built against what the curaduría authorised.
  3. Put meter readings, the inventory of keys and remotes, and every observation with the open item it creates in writing.
  4. Check the handover points that belong to beach lots: where the zona de bajamar ends: it is public domain of the Nation, cannot be sold, and no private deed cures it; whether the lot has its own matrícula inmobiliaria or was never split out, and whether the chain of title carries falsa tradición (a transfer by someone who never held registered ownership) or mere possession and how much of the lot is actually buildable once the public strip, the ronda hídrica (protected water margin) and the environmental setback are taken out.
  5. Add what has to be verified in Barceloneta: which municipality the land belongs to, because the northern strip borders Santa Catalina and land-use certificates and permits are not issued by the same authority on either side of that line; how the title was created, since there is adjudicated rural land and parcels carrying falsa tradición, and whether the registry folio has been split off from the parent tract and whether water, power and wastewater come from public networks or private solutions, and who answers for the access road to the lot.
  6. If you cannot attend, grant a power of attorney to someone who receives on your behalf, and require the signed acta plus photographs and video of the walkthrough the same day.

Mistakes that cost money

  • Signing the acta with no observations so as not to delay handover. It is the most expensive waiver in the process, and it is made out of politeness.
  • Taking delivery without clearance certificates for dues and utilities. The unpaid account follows the property, not the seller who left.
  • Leaving an open item in a WhatsApp message. The acta gets signed; the message gets deleted.

Frequently asked questions

Can I take delivery of a beach lot without travelling to Cartagena?
Yes, with a power of attorney granted before a Colombian consul or apostilled. Whoever receives should be someone technical, not the same broker who sold it.
Who do I claim from after handover?
It depends on what was signed: the builder for what was warranted, the seller for what was promised, and the administración for anything that is common property. That is why the acta is drafted with names in it.
Is video of the walkthrough worth anything?
It backs up what was written in the acta. It does not replace it: the signed document is what binds.
