Appraising an apartment under propiedad horizontal in Serena del Mar: who signs the avalúo comercial and how

The coast at Cartagena de Indias, Colombia

An avalúo comercial —a signed appraisal report— is not an opinion about price: it is a document a licensed perito avaluador stands behind. Before any money moves, find out who prepared it, by what method and for whom, because the appraisal the lender orders and the one the seller shows you are two different documents.

The method follows the nature of the property, which is why the appraisal of an apartment under propiedad horizontal is not assembled like any other. Where comparable units exist in the same sector the perito works by market comparison; where the subject is undeveloped land or a property with no close referents, the residual and replacement-cost methods appear, and those rest on planning and construction assumptions a buyer can read and challenge. On top of that sits a common confusion: the avalúo catastral published by IGAC —the assessed value— is the base for the impuesto predial, the property tax, and never claims to be market value. And an appraisal commissioned by a lender exists to measure that lender's own collateral, under prudential criteria that are not the buyer's. All of it decides money: how much the bank advances, how much the seller asks, and what ends up written in the deed.

Buying under propiedad horizontal —Colombia's condominium regime— means joining a legal entity that already exists and whose rules are not negotiated at the closing table. You accept the reglamento whole, together with what earlier asambleas (owners' meetings) resolved and whatever future ones resolve by majority, with no veto. That changes what due diligence is about. On a house, a title review follows the chain of ownership of the lot; here it also has to read the internal life of a community you become a compulsory member of: who administers it, which body approves an extraordinary levy, what the recent asambleas decided, and whether the building is current on what it must repair. It changes who collects, too. Beyond the municipal impuesto predial, the unit generates a monthly dues payment made to the administración for as long as you own it, whether or not you use the apartment, and whatever a previous owner left unpaid follows the unit rather than the person, which makes the administración's certificate as important as the registry's. For a buyer living abroad, the practical consequence is appointing someone to receive notices and vote, because the asamblea does not wait.

Serena del Mar runs on rules of its own. The land is developed under a plan parcial, a master plan adopted by District decree, and that decree, not a general reading of the POT, the city land-use plan, is what sets uses, land transfers to the city and development obligations for a given lot. So the document to request here is the adopting decree with its drawings; the land-use certificate that serves in a settled neighborhood is not enough. The second difference is a layer of private government that exists nowhere else: the ciudadela, the master community, has its own statutes, an architectural committee and design rules governing façades, fences and renovations, and those rules follow the property on resale, binding a buyer who never negotiated them. The third is the counterparty: you usually deal with the developer or with a fiduciaria, a trust company, administering the stages, and the unit's registry record descends from a very large parent parcel subdivided in phases, so title is verified upward, to the matriz, the parent record, and to the deeds transferring land to the District. Infrastructure was built by the developer: what matters is whether it has been handed over to the utility or is still privately held.

What is specific to Serena del Mar

A city planned from scratch along the Anillo Vial, with its own street grid, institutional amenities and phased stages. There are tower apartments, condominium houses and serviced lots, and what is on offer depends on which stage is open. It has direct access from the Anillo Vial and a transport terminal on the city's northern side.

  • which stage of the master plan the property sits in, because the development obligations and infrastructure timelines differ between them
  • which amenities are actually built and which are merely approved, a distinction the sales office does not always draw
  • how the master-community dues work alongside the individual complex's dues, which are two separate charges that add up

What to verify, step by step

  1. Ask for the complete appraisal report rather than the summary page: it has to name the signer, the perito's registration, the date and the method used.
  2. Check the appraiser against the open register kept by the Lonja de Propiedad Raíz de Bolívar, which can be consulted from abroad.
  3. Compare the area, boundaries and identification of the property in the appraisal against the IGAC cadastral record and the certificado de tradición y libertad, the registry history of the property.
  4. Go through the items specific to apartments under propiedad horizontal that the appraiser should have had in front of him: the unit's coeficiente de copropiedad —its ownership share— as recorded in the reglamento, since it drives both the monthly dues and the weight of the vote at the asamblea; which bienes comunes de uso exclusivo (common property assigned to one unit for its sole use) the deed attaches to the apartment —parking, storage, patio— and whether they match what is being shown and whether the reglamento de propiedad horizontal and the minutes of the last asamblea agree on interior remodelling, pets and renting.
  5. Add what the sector itself forces you to check in Serena del Mar: which stage of the master plan the property sits in, because the development obligations and infrastructure timelines differ between them; which amenities are actually built and which are merely approved, a distinction the sales office does not always draw and how the master-community dues work alongside the individual complex's dues, which are two separate charges that add up.
  6. If there will be a mortgage, ask the lender which appraisal it requires and confirm with the Superintendencia Financiera that the institution is supervised before handing over documents or funds.

Mistakes that cost money

  • Treating the seller's appraisal as neutral. The seller paid for it and it was written to support the asking figure; still ask for it, but read who commissioned it.
  • Asking the appraiser for a number instead of the report. What lets you argue about value are the assumptions and the comparables, not the conclusion.
  • Assuming the appraisal replaces a title search. The perito values the property; he does not establish who may sell it.

Frequently asked questions

Can I commission my own appraisal of an apartment under propiedad horizontal without being in Cartagena?
Yes. The perito needs access to the property and its documents, not the buyer's presence; the signed report can be delivered by email.
Why is the lender's appraisal below the asking price?
Because it measures the institution's collateral, not the negotiation between the parties. They are two documents with different purposes and it is worth having both.
Is the avalúo catastral useful for negotiating?
It is useful for understanding the base of the impuesto predial, which is what IGAC and the District publish. For market value you order an appraisal from a registered perito.
