The purchase gets recorded even when the money came in badly, and that is the trap: the deed is registered and the investment is not. A buyer from Bogotá discovers the gap when it is time to sell or to move funds out, which is when it can no longer be fixed without a procedure.
This is not the same as proving where the money came from. Proving the source is the due diligence the real estate sector is required to carry out and which the UIAF explains. Registering foreign investment is an exchange-control operation: the funds have to enter through the regulated foreign-exchange market with their declaración de cambio (exchange declaration), through an authorised intermediary, and the Banco de la República is the body that states how it is registered, under which heading and in whose name. What decides money is the name: whoever sends the funds, whoever appears on the escritura and whoever holds the registration must be the same party, because that registration is what later supports the operation in reverse. And if the money goes into a patrimonio autónomo (a trust estate) before reaching the deed, there is one more check: that the fiduciaria exists and is supervised, which you verify at the Superintendencia Financiera and not in the project brochure.
The mortgage comes from a Colombian bank, against a local credit history, not from a bank abroad and not from the seller: the bank pulls your record from the centrales de riesgo, the credit bureaus, asks for proof of income and orders its own avalúo, the appraisal, and title study. Whoever answers for the approval is the bank's mortgage department, not the sales office. Ask in writing for the approval letter and the disbursement instructions, because each disbursement is supported by a different document: first the promesa de compraventa, the purchase promise, and then the escritura once registered with the mortgage recorded on it. The money does not enter through the regulated exchange market and there is no foreign investment to register with the Banco de la República; what does have to be assembled is proof of the source of funds, which is a separate matter and is requested by the bank and the notaría. You can sign in person, so no poder and no apostille are needed, yet you manage the property from another city: settle who receives it, who pays the predial, the property tax, and the building fee, and who issues the paz y salvo, the clearance certificate, before each step. What sets you apart from a Medellín buyer is not the law, which is the same, but the channel: your file is usually studied in the city where you live. Tax questions go to the DIAN and to an accountant.
Here the file is complicated by a neighbor nobody negotiates with: the air terminal. The neighborhood sits under the approach path, so a building project is not reviewed only by the curaduría urbana, the private office that grants permits, but also by the civil aviation authority, which sets the obstacle limitation surfaces, and by the operator running the airport under concession. That reorders the procedure: before buying with any plan to add height, request the land-use opinion from the District and ask about the aviation ruling, because that is where a seller's assumptions collapse. On top of height there is noise exposure, which never appears on the certificado de tradición y libertad, the registry history and encumbrance certificate, and does appear in the airfield regime, so the exposure sits in the rules over the land rather than in the title itself. The counterparty differs too: a formal neighborhood of long-standing owners, with unsettled sucesiones, estate proceedings, and houses carved into several apartments without registering the split, so compare the original permit against what stands before accepting a per-unit valuation.
What is specific to Crespo
The neighborhood you cross to enter or leave the city: residential, fully built out and pressed against the air terminal, with its own seafront. Family houses and residential buildings sit alongside apartments used for short stays because of how close the terminal is. It is the hinge between downtown and the Zona Norte: the exit to the Anillo Vial and the way into Rafael Núñez airport both run through it.
- what building height the lot allows under the airport approach path, because the aviation restriction stacks on top of District zoning and is the first fact left out when a lot is offered
- whether what stands matches the permit and the registry folio, a common gap in family houses split into apartments without registering the split
- how shoreline protection in front of the property was resolved and which body answers for that work, because it is not the seller
What to verify, step by step
- Before transferring anything, ask the Banco de la República which channel the funds must use, which declaración de cambio supports them, under which heading an investment in real estate is registered and in whose name the registration ends up.
- What a buyer from Bogotá has to settle with their bank and with the intermediary before the first transfer: what the bank requires in order to study the loan, who approves it and which document supports each disbursement, asked in writing before you sign the promesa; what proof of source of funds the bank and the notaría want, which is not the same thing as registering foreign investment and who receives the property, who pays the predial and the building fee, and who issues the paz y salvo while you live in another city.
- Ask the foreign-exchange intermediary in writing for proof of the operation and a copy of the exchange declaration, and keep them with the deed: that is the support you will be asked for years later.
- If the money enters a patrimonio autónomo or a project trust in Crespo, verify at the Superintendencia Financiera that the fiduciaria exists and is supervised, and confirm the destination account belongs to the trust estate and not to the developer.
- Assemble the source-of-funds documentation the UIAF sets out as the sector's duty, because the broker and the notaría are required to request it and the closing stops without it.
- Confirm that the name and identification number on the transfer, on the promesa and on the deed match exactly, and correct any difference before signing.
Mistakes that cost money
- Wiring outside the regulated exchange market because the ordinary transfer arrived sooner. The purchase records anyway and the investment goes unregistered.
- Letting a relative or an account in another name send the money. The registration follows whoever sent it, and that name has to be the one on the deed.
- Confusing source-of-funds evidence with exchange registration. They are two duties before two different authorities, and meeting one does not cover the other.
Frequently asked questions
- How is this different from proving the source of funds?
- Source of funds is the due diligence the UIAF explains and which the broker and the notaría require. Exchange registration sits with the Banco de la República and is what supports the investment. You need both.
- Can a buyer from Bogotá register the investment after signing?
- That is precisely the question to put to the Banco de la República before transferring, because a later correction is a separate procedure. Do not decide it on what the seller tells you.
- Who do I ask whether the project's trust company is sound?
- The Superintendencia Financiera, which is who states whether that company exists and is supervised. Before transferring money to a trust estate, that check comes first.
Where to check it
- Banco de la República — registration of foreign investment and the official exchange rate
- Superintendencia Financiera de Colombia — whether a trust company exists and is supervised, before transferring money to a patrimonio autónomo
- UIAF — the anti-money-laundering obligations that apply to the real estate sector
- Cartagena de Indias — the rules of the municipality Crespo belongs to
