Down payment and payment schedule for an apartment under propiedad horizontal in Castillogrande: who receives the money and what documents it

The coast at Cartagena de Indias, Colombia

Between the reservation and the deed of an apartment under propiedad horizontal there is a chain of payments, and each one needs an identified recipient and a document behind it. Whatever that chain fails to record is what later cannot be claimed or proved.

A payment schedule is not just a calendar: it answers three questions that decide money. Who the money is paid to, because paying the sales agent, an individual, or an account that appears nowhere in the signed document leaves the buyer with no claim against whoever is actually selling. What document supports each payment, because a cash receipt does not say which obligation it is applied against, and that application is precisely what gets argued when something breaks. And under what structure the money is held, because a finished apartment under propiedad horizontal and one still to be built are neither paid for the same way nor held by the same third party. When the buyer wires from abroad, the trail of the transfer is added: the bank and the Banco de la República record how the funds came in, and that record is what gets asked for when selling or sending funds back out. What applies to your case is a question for your bank, the fiduciaria and your attorney, not something to infer from a brochure.

Buying under propiedad horizontal —Colombia's condominium regime— means joining a legal entity that already exists and whose rules are not negotiated at the closing table. You accept the reglamento whole, together with what earlier asambleas (owners' meetings) resolved and whatever future ones resolve by majority, with no veto. That changes what due diligence is about. On a house, a title review follows the chain of ownership of the lot; here it also has to read the internal life of a community you become a compulsory member of: who administers it, which body approves an extraordinary levy, what the recent asambleas decided, and whether the building is current on what it must repair. It changes who collects, too. Beyond the municipal impuesto predial, the unit generates a monthly dues payment made to the administración for as long as you own it, whether or not you use the apartment, and whatever a previous owner left unpaid follows the unit rather than the person, which makes the administración's certificate as important as the registry's. For a buyer living abroad, the practical consequence is appointing someone to receive notices and vote, because the asamblea does not wait.

In Castillogrande the typical deal is not a unit in a condominium but a house and its lot, which puts the weight of the file back on the chain of title to the land: you climb through the deeds to the parcelación, the original subdivision that created the block, because those platting deeds registered conditions, setbacks and easements that still bind and that are invisible from the street. There is no building manager to issue a paz y salvo, a no-arrears certificate, and no assembly to settle anything, so boundary questions with a neighbor are argued between private parties and what governs is the title and the survey, not a set of house rules. The counterparty is usually an old city family and, fairly often, a family company that owns the property: then you must decide whether to buy the real estate or the company's shares, two different transactions with different paperwork and different exposure, and request the certificado de existencia y representación, the corporate good-standing and signing-authority certificate, together with the resolution approving the sale. And because the neighborhood is fully built out, any construction is permitted on an already developed lot, with neighbors entitled to take part in the proceeding.

What is specific to Castillogrande

The residential tip of the peninsula: lower and quieter than Bocagrande, facing the bay, with little street retail. Houses and low-rise buildings sit alongside new towers, and single-family homes still exist. It is a dead end: access is through Bocagrande with no through road at the far tip, which keeps it free of passing traffic.

  • whether the property faces the bay or the open sea, because the swell, the smell and the façade upkeep are not comparable
  • what building height the rules allow on the lot, which is not uniform across the peninsula and is the first fact omitted when a lot is sold
  • how ground stability was addressed, given this is land reclaimed from the sea, and what the soil study for the building says

What to verify, step by step

  1. Ask in writing for the full payment schedule showing the name, tax identifier and bank account of the recipient of every instalment, and confirm that recipient is the same party signing the document.
  2. Require each payment to be applied against an obligation in the signed document, with the receipt stating which item it covers and over which property.
  3. Ask whether what you are signing is a promesa de compraventa, a reservation or a deposit instruction, because that decides what delivery you are buying and from whom.
  4. Check what belongs to an apartment under propiedad horizontal itself and shapes how its payments are structured: the unit's coeficiente de copropiedad —its ownership share— as recorded in the reglamento, since it drives both the monthly dues and the weight of the vote at the asamblea; which bienes comunes de uso exclusivo (common property assigned to one unit for its sole use) the deed attaches to the apartment —parking, storage, patio— and whether they match what is being shown and whether the reglamento de propiedad horizontal and the minutes of the last asamblea agree on interior remodelling, pets and renting.
  5. If you are wiring from outside Colombia, ask your bank and the Banco de la República what record the operation leaves, and keep a copy of every transfer document naming the property.
  6. Before the deed, order the updated folio from the Oficina de Registro and compare the registered owner against the recipient you have been paying.

Mistakes that cost money

  • Wiring to an account sent to you by message. The valid account is the one in the signed document, and a change of account is confirmed through the company's own channel, never through the message that requested it.
  • Accepting receipts with no application stated. A receipt that says only «payment on account» proves nothing about which obligation was paid when more than one document is in play.
  • Leaving the transfer trail to be assembled at the end. Reconstructing later how each instalment came in is harder than asking for the document on the day.

Frequently asked questions

Can the down payment be wired to the seller as an individual?
That depends on who appears as seller in the signed document and on the folio. Compare the two and ask your attorney what record each option leaves before you wire.
What role does the fiduciaria play in the payment schedule?
Where funds are received through a patrimonio autónomo (a trust estate), the fiduciaria holds the money and can certify what you paid in. Ask it for that certificate, not only the seller.
Can I pay from an account that is not in my name?
That is a decision with banking and tax consequences, answered by your bank and your adviser rather than the seller. What does help is that the signing buyer and the account holder both appear on the supporting document.
