Recorded use of an off-plan new construction in La Boquilla: what the cadastre says and what happens when it does not match

The coast at Cartagena de Indias, Colombia

Every property carries a recorded economic use in the cadastre, and the one attached to an off-plan new construction is not always the use it actually serves. That line is no administrative detail: it is the basis on which property tax is assessed and the record checked whenever a permit is requested.

Economic use is the classification IGAC assigns to a property on its cadastral record —residential, commercial, vacant land, mixed— and it travels together with the area, the boundaries and the valuation. When the record says one thing and the property does another, the mismatch surfaces at three awkward moments: when the Distrito assesses property tax, when a ruling or a permit is applied for and the file does not line up, and when the buyer comes to sell and the title search compares the cadastral record against the registry folio. For an off-plan new construction the mismatch has typical causes, and it is worth knowing which one is yours before signing, because the correction is filed with the cadastral authority and is not solved at the notaría on signing day. What classification your property carries and how it is corrected are questions for IGAC or the Distrito's cadastral authority; what it means for your taxes is one for your adviser.

Off-plan new construction is bought differently because at signing the property does not yet exist: what exists is a project, a permit and a company that has to stay standing until delivery. The document, not the apartment, is therefore what gets reviewed. The first thing that changes is the path of the money: instalments are paid into a patrimonio autónomo —a trust estate— administered by a fiduciaria rather than into the builder's own account, and it is worth knowing what conditions must be met before those funds are released to the works. The second is that what you sign may be a promesa de compraventa, a binding promise of sale, or only an encargo fiduciario, a trust deposit instruction; they do not bind alike and do not unwind alike, and what happens if the project never starts depends on which one it is. The third is that the unit's identity rests on a plan that allows adjustment, so read which tolerances and specification changes the seller reserved and how the buyer is told of them. The fourth, for a buyer abroad, is duration: every transfer has to be documented and someone has to be empowered to sign and take delivery years later.

Buying here rarely means dealing with a private owner holding a clean folio de matrícula inmobiliaria, the registry record of a property. The counterparty is usually a family that has occupied the land for generations and documents its right with private papers, or a consejo comunitario, a community council whose legal representation is certified by the Ministerio del Interior rather than by a notary. That is the first procedural difference: before price comes up you need to know who may sign and under what acta, or board resolution, they were authorized, because a deal with someone who does not represent the collective never becomes a registrable deed. The second is that land in this corregimiento, an outlying township, passed down by occupation and inheritance with no registered partition, so what exists is often an unsettled sucesión, an estate proceeding, with boundaries described by neighbors. The third is authority: along this strip the District does not decide alone, because Cardique, the environmental agency, and DIMAR, the maritime authority, both weigh in, and on collective territory consulta previa, prior consultation, also applies. Infrastructure is uneven: the Anillo Vial is a major road and the village's inner streets are another matter, with water connections and wastewater worth confirming with the utility before counting on them.

What is specific to La Boquilla

A fishing village wedged between the sea and the Ciénaga de la Virgen, which the hotel corridor grew into without displacing the community. Seafront towers along the Anillo Vial coexist with community-origin informal housing a few blocks inland. It is the natural gateway to the Zona Norte from Crespo and the airport along the Anillo Vial, which is also what congests it in high season.

  • whether the land falls inside the La Boquilla community council's territory, because collective title does not transfer like ordinary property and some sales can never be registered
  • where the tidal zone ends, since it is public domain of the Nation and cannot be privately owned no matter how fenced it looks or what the deed says
  • whether the chain of title carries falsa tradición, common here, which blocks mortgage financing outright

What to verify, step by step

  1. Order the property's cadastral record by its registry folio and read the recorded economic use, the built area and the land area exactly as they appear, not as the listing describes them.
  2. Compare that record against the certificado de tradición y libertad (the title and encumbrances certificate) from the Ventanilla Única de Registro: property identification, area and boundaries must tell the same story.
  3. Ask the Alcaldía which use the property tax is currently being assessed under, and since when.
  4. Check what belongs to an off-plan new construction itself and explains why its record may not match: which patrimonio autónomo (the trust estate holding buyers' funds) the instalments are paid into and which fiduciaria administers it, because the money should not reach the builder's own account; whether the licencia de construcción has actually been issued or the project is still in prelanzamiento, and what punto de equilibrio (the pre-sale threshold) must be met before building starts and what the signed document says about the return of funds if that threshold is never met, and whether you signed a promesa de compraventa or only an encargo fiduciario (a trust deposit instruction).
  5. Where there is a mismatch, ask the cadastral authority which correction or mutación application applies, who may file it and what supporting documents it takes; the filing starts without travelling, with a power of attorney where a signature is needed.
  6. Have the promesa state who files the correction, with what supporting documents, and what happens to closing if the cadastral authority has not yet ruled.

Mistakes that cost money

  • Confusing cadastral use with POT land use. The POT says what is allowed in the polygon; the cadastre says how the property is classified, and you can be in order with one and not the other.
  • Taking the record the seller hands you at face value. Order it yourself and recently dated, because a cadastral mutación changes the record without changing the deed.
  • Assuming the correction is notarial business. The record is amended by the cadastral authority, and a deed does not take its place.

Frequently asked questions

Where is the recorded economic use consulted?
On the property's cadastral record, with IGAC or whichever cadastral authority operates in the municipality. The registry folio from the Ventanilla Única de Registro is used to cross-check it.
Can a deed be signed while the recorded use is out of date?
That is a question for the notary and your attorney, since it depends on what the particular transaction requires. What you can verify before signing is what the record says today and what filing is pending.
Who is asked for the correction when the record does not match?
The competent cadastral authority, which is what amends the record. The Alcaldía comes in for whatever affects the property tax assessment.
