A title review tells you who may sell; a technical inspection tells you what is being sold. They are two separate engagements, both paid for by the buyer, and in La Boquilla the second one is usually skipped because the buyer is not in the city to open the door.
What gets inspected is not the same checklist for every property: when what you are buying is a property for short-stay rental, the report has to address what the nature of that property actually puts at risk, not a generic form about damp patches and sockets. That matters for money and for timing. For money, because a repair not found before the promesa de compraventa is signed gets paid for afterwards by the buyer, and in a propiedad horizontal (condominium regime) it can end up shared among all owners through a special assessment. For timing, because before the promesa whatever turns up is a matter for negotiation, and afterwards it is only a claim. The report is signed by a professional who answers for what it says; nobody signs the brochure.
A property bought for short-stay rental is bought differently because what changes hands is an operation, not just real estate. Three things that live in separate documents have to line up for it to work: the copropiedad's reglamento, which can ban renting by the day regardless of any other permission; the registro nacional de turismo, the national tourism register, which is issued in someone's name and does not travel automatically with the deed; and the contract with the operator, which sets who attends to the guest, who pays for supplies and what is deducted before income is split. The second difference is that much of the value cannot be recorded anywhere: furniture, equipment, inventory, review history and bookings already taken appear on no folio, so they have to be inventoried and the purchase document has to say what becomes of each, including stays already sold for dates after closing. The third is that a guest is not a tenant and the activity is a trade, with daily attention, staff and restocking, so a buyer abroad is engaging a management arrangement, not merely acquiring a property.
Buying here rarely means dealing with a private owner holding a clean folio de matrícula inmobiliaria, the registry record of a property. The counterparty is usually a family that has occupied the land for generations and documents its right with private papers, or a consejo comunitario, a community council whose legal representation is certified by the Ministerio del Interior rather than by a notary. That is the first procedural difference: before price comes up you need to know who may sign and under what acta, or board resolution, they were authorized, because a deal with someone who does not represent the collective never becomes a registrable deed. The second is that land in this corregimiento, an outlying township, passed down by occupation and inheritance with no registered partition, so what exists is often an unsettled sucesión, an estate proceeding, with boundaries described by neighbors. The third is authority: along this strip the District does not decide alone, because Cardique, the environmental agency, and DIMAR, the maritime authority, both weigh in, and on collective territory consulta previa, prior consultation, also applies. Infrastructure is uneven: the Anillo Vial is a major road and the village's inner streets are another matter, with water connections and wastewater worth confirming with the utility before counting on them.
What is specific to La Boquilla
A fishing village wedged between the sea and the Ciénaga de la Virgen, which the hotel corridor grew into without displacing the community. Seafront towers along the Anillo Vial coexist with community-origin informal housing a few blocks inland. It is the natural gateway to the Zona Norte from Crespo and the airport along the Anillo Vial, which is also what congests it in high season.
- whether the land falls inside the La Boquilla community council's territory, because collective title does not transfer like ordinary property and some sales can never be registered
- where the tidal zone ends, since it is public domain of the Nation and cannot be privately owned no matter how fenced it looks or what the deed says
- whether the chain of title carries falsa tradición, common here, which blocks mortgage financing outright
What to verify, step by step
- Ask the curaduría urbana (the private permitting office) for the licencia de construcción and the approved plans, and check what use, area and height that permit actually authorised against what you are being shown. Anything built beyond it is not cured by the deed.
- What the report has to address point by point for a property for short-stay rental: whether the reglamento de propiedad horizontal permits daily rentals, because the copropiedad's own ban binds you even with the registro nacional de turismo (the national tourism register) in order; in whose name the registro nacional de turismo is issued and what becomes of it when the property is sold and whether there is an operator or management contract and which expenses are deducted before the income is split.
- And what the same report should pick up for the sector in La Boquilla: whether the land falls inside the La Boquilla community council's territory, because collective title does not transfer like ordinary property and some sales can never be registered; where the tidal zone ends, since it is public domain of the Nation and cannot be privately owned no matter how fenced it looks or what the deed says and whether the chain of title carries falsa tradición, common here, which blocks mortgage financing outright.
- Engage the visit with an engineer or architect you hire yourself, not the one the seller offers, and require a written report with dated photographs, a signature and the professional's licence number. Ask Camacol Bolívar who carries out technical surveys in the region and ask for references you can check.
- Agree in writing with the seller on the date of the visit and on access to the property before signing the promesa, and attach the report to the promesa together with the agreed repairs and who pays for them.
- Ask the District whether any administrative proceeding is open against the property for building without a permit or for breaching planning rules, because that follows the property and not the seller.
Mistakes that cost money
- Accepting the report the seller or the developer hands over. The useful report is the one the buyer commissioned and can question.
- Leaving the inspection until after the promesa, when the price is already agreed. Whatever surfaces then is argued from the weaker position.
- Confusing the technical inspection with the title review. One looks at the construction and the other at the chain of ownership; you need both, and not from the same person.
Frequently asked questions
- Can the inspection be done without being in Cartagena?
- Yes, and it usually is: you hire the professional, arrange access with the seller and receive the signed report. What you should not delegate is choosing who does it.
- Does the inspection change with the type of property?
- In substance, yes. What has to be verified on a property for short-stay rental comes from the nature of the property —what is privately owned, what is common property, what the permit authorises— and not from a general list of finishes.
- Who pays for repairs the report turns up?
- Whoever agreed to in writing. If the report is attached to the promesa with the fixes and who owes them, you have something to enforce; if it lives in an email, you do not.
