Insuring a property for short-stay rental in La Boquilla: which policies apply and who takes them out

The coast at Cartagena de Indias, Colombia

Most foreign buyers assume the building is already insured and that this covers them. The association's policy and the owner's own policy cover different things, and between the two sits a gap that shows up on the day of a loss.

The association's policy covers the building's common property and the administrador takes it out against the budget; the owner's policy covers the private area, the contents and third-party liability, and you take that one out. For a property for short-stay rental the boundary between them does not fall in the same place, and that is the exposure: what is bien común de uso exclusivo for one unit is private area for another, and a terrace, a boundary wall or an air-conditioning unit can end up outside both policies. Where there is a mortgage the lender also requires its own cover as a condition of disbursement, and charges it inside the instalment. Before signing any of them, confirm with the Superintendencia Financiera that the insurer is supervised, and before insuring anything, find out what risk information the District holds on that property.

A property bought for short-stay rental is bought differently because what changes hands is an operation, not just real estate. Three things that live in separate documents have to line up for it to work: the copropiedad's reglamento, which can ban renting by the day regardless of any other permission; the registro nacional de turismo, the national tourism register, which is issued in someone's name and does not travel automatically with the deed; and the contract with the operator, which sets who attends to the guest, who pays for supplies and what is deducted before income is split. The second difference is that much of the value cannot be recorded anywhere: furniture, equipment, inventory, review history and bookings already taken appear on no folio, so they have to be inventoried and the purchase document has to say what becomes of each, including stays already sold for dates after closing. The third is that a guest is not a tenant and the activity is a trade, with daily attention, staff and restocking, so a buyer abroad is engaging a management arrangement, not merely acquiring a property.

Buying here rarely means dealing with a private owner holding a clean folio de matrícula inmobiliaria, the registry record of a property. The counterparty is usually a family that has occupied the land for generations and documents its right with private papers, or a consejo comunitario, a community council whose legal representation is certified by the Ministerio del Interior rather than by a notary. That is the first procedural difference: before price comes up you need to know who may sign and under what acta, or board resolution, they were authorized, because a deal with someone who does not represent the collective never becomes a registrable deed. The second is that land in this corregimiento, an outlying township, passed down by occupation and inheritance with no registered partition, so what exists is often an unsettled sucesión, an estate proceeding, with boundaries described by neighbors. The third is authority: along this strip the District does not decide alone, because Cardique, the environmental agency, and DIMAR, the maritime authority, both weigh in, and on collective territory consulta previa, prior consultation, also applies. Infrastructure is uneven: the Anillo Vial is a major road and the village's inner streets are another matter, with water connections and wastewater worth confirming with the utility before counting on them.

What is specific to La Boquilla

A fishing village wedged between the sea and the Ciénaga de la Virgen, which the hotel corridor grew into without displacing the community. Seafront towers along the Anillo Vial coexist with community-origin informal housing a few blocks inland. It is the natural gateway to the Zona Norte from Crespo and the airport along the Anillo Vial, which is also what congests it in high season.

  • whether the land falls inside the La Boquilla community council's territory, because collective title does not transfer like ordinary property and some sales can never be registered
  • where the tidal zone ends, since it is public domain of the Nation and cannot be privately owned no matter how fenced it looks or what the deed says
  • whether the chain of title carries falsa tradición, common here, which blocks mortgage financing outright

What to verify, step by step

  1. Ask the administrador for the current certificate of the association's policy, with its cover, exclusions and the insurer's name.
  2. Ask for the reglamento and the deed so you know where the unit's private area ends and common property begins, which is the line that decides which policy responds.
  3. Verify with the Superintendencia Financiera that the insurer and the intermediary are supervised before paying any premium.
  4. Review what has to be insured because it is properties for short-stay rental: whether the reglamento de propiedad horizontal permits daily rentals, because the copropiedad's own ban binds you even with the registro nacional de turismo (the national tourism register) in order; in whose name the registro nacional de turismo is issued and what becomes of it when the property is sold and whether there is an operator or management contract and which expenses are deducted before the income is split.
  5. Add the exposures particular to La Boquilla: whether the land falls inside the La Boquilla community council's territory, because collective title does not transfer like ordinary property and some sales can never be registered; where the tidal zone ends, since it is public domain of the Nation and cannot be privately owned no matter how fenced it looks or what the deed says and whether the chain of title carries falsa tradición, common here, which blocks mortgage financing outright.
  6. Ask the District what risk information it holds on the property and hand that to your insurance broker before asking for quotes.

Mistakes that cost money

  • Assuming the building's policy covers the inside of the apartment. It insures common property, and your own contents fall outside it.
  • Buying the lender's policy without reading what it covers. It protects the creditor's collateral, which is not the same as protecting you.
  • Letting the certificate lapse and finding out at the moment of a loss. Ask the administrador for the renewal date and ask again each year.

Frequently asked questions

Can I insure a property for short-stay rental from abroad?
Yes, through an insurer supervised in Colombia, arranged by email with a broker; payment and billing are coordinated with him.
Who files the claim when the damage is to common property?
The administración, under the association's policy. The owner claims his own loss under his own policy, which is why both should be identified before buying.
Does the lender's policy work as my property insurance?
It answers what the institution requires for its collateral. What is missing for you is a question for your broker, with the reglamento and the deed in front of him.
