Utilities for an apartment under propiedad horizontal in El Laguito: availability, meter and prior debt

Water running on the day of the visit does not prove that availability has been certified, and the meter feeding an apartment under propiedad horizontal is not always registered to the property itself. These are two separate documents, issued by different bodies, and a buyer who asks for neither inherits whatever was never checked.

Service availability is evidenced by a certification from the utility company for that specific property, and it is the document the curaduría looks at when a permit is requested. A seller's word, a temporary hook-up or a line drawn from a neighbour are not the same thing, and the difference decides whether an apartment under propiedad horizontal can be lived in, conveyed or remodelled. Alongside that sits the bill: in Colombia utility balances follow the property rather than the person who ran them up, so the account status and the name recorded on the meter belong in the promesa de compraventa (the binding promise of sale) and not in an act of trust. How much is owed is for the utility to state; who pays it is what gets agreed in writing before signing.

Buying under propiedad horizontal —Colombia's condominium regime— means joining a legal entity that already exists and whose rules are not negotiated at the closing table. You accept the reglamento whole, together with what earlier asambleas (owners' meetings) resolved and whatever future ones resolve by majority, with no veto. That changes what due diligence is about. On a house, a title review follows the chain of ownership of the lot; here it also has to read the internal life of a community you become a compulsory member of: who administers it, which body approves an extraordinary levy, what the recent asambleas decided, and whether the building is current on what it must repair. It changes who collects, too. Beyond the municipal impuesto predial, the unit generates a monthly dues payment made to the administración for as long as you own it, whether or not you use the apartment, and whatever a previous owner left unpaid follows the unit rather than the person, which makes the administración's certificate as important as the registry's. For a buyer living abroad, the practical consequence is appointing someone to receive notices and vote, because the asamblea does not wait.

The procedural difference here is not the land but the building: almost everything is older, dense propiedad horizontal, the condominium regime, and the decision-maker is not the District but the owners' assembly acting through its bylaws. Buying means reading those bylaws before any brochure, reviewing recent assembly minutes, and asking the building manager for the paz y salvo, a no-arrears certificate, the approved budget and any special assessments, because a repair levy already voted passes to the buyer who never voted on it. Since the area lives on lodging, the registro nacional de turismo, the national tourism registry, joins in: the provider must be registered, the bylaws must permit that use, and the two must agree, because one is demanded by a national body and the other depends on the neighbors. The counterparty is usually an owner already renting the unit, sometimes through an operator under a live management contract, so establish what transfers with the property and what stays tied to the previous operator.

What is specific to El Laguito

The tip of Bocagrande, surrounded by water on almost every side and given over to visitor lodging since it was built. Older, very dense apartment towers, with much of the inventory given to short stays and apartment-hotels. The only way in is across Bocagrande along a narrow road that ends at the point, with no alternative exit.

  • what the reglamento de propiedad horizontal, the condominium bylaws, say about renting by the night, since the assembly may have restricted it and that decides the business
  • whether the unit and the building hold registro nacional de turismo entries, the national tourism registry, and in whose name, because the duty falls on whoever provides the service
  • the condominium's accounts and pending lawsuits, along with façade and pipework upkeep in a building exposed to salt air

What to verify, step by step

  1. Ask the utility company for a water and sewer availability certification issued for the property's registry folio, not for the development or the sector.
  2. Request the latest account statement for each service and ask the company whether there are payment arrangements, refinancings or disputed charges on that meter.
  3. Check whose name the meter is in and whether it matches the unit being shown: in a copropiedad, individual meters sit next to common-area services billed through the dues.
  4. Check what belongs to an apartment under propiedad horizontal itself and does not change with the sector: the unit's coeficiente de copropiedad —its ownership share— as recorded in the reglamento, since it drives both the monthly dues and the weight of the vote at the asamblea; which bienes comunes de uso exclusivo (common property assigned to one unit for its sole use) the deed attaches to the apartment —parking, storage, patio— and whether they match what is being shown and whether the reglamento de propiedad horizontal and the minutes of the last asamblea agree on interior remodelling, pets and renting.
  5. Check in addition what El Laguito requires in particular, with the authority that imposes it: what the reglamento de propiedad horizontal, the condominium bylaws, say about renting by the night, since the assembly may have restricted it and that decides the business; whether the unit and the building hold registro nacional de turismo entries, the national tourism registry, and in whose name, because the duty falls on whoever provides the service and the condominium's accounts and pending lawsuits, along with façade and pipework upkeep in a building exposed to salt air.
  6. Have the promesa state who answers for balances predating closing, and ask for the paz y salvo (a clearance certificate for the account) before signing; it can be requested without being in Colombia.

Mistakes that cost money

  • Treating the bill the seller shows you as an account statement. A bill covers one billing period; a statement shows the balance and any arrangements in force.
  • Assuming service because the main runs along the street. A main in front of the lot and a metered connection to the lot are different things, and on land purchases that is exactly where the sums fail.
  • Forgetting common-area services. In a copropiedad the lift, pump and lighting consumption arrives through the administration dues, not through the unit's own bill.

Frequently asked questions

Does the seller's utility debt pass to the buyer?
The balance is charged against the property, so it is a point to be agreed expressly in the promesa. Ask the utility for a certification of the account status and have your attorney review how that clause was drafted.
Who issues the availability certification?
The company that provides the service at that property. The curaduría and the Alcaldía require it as an annex, but they do not issue it.
Can all of this be requested from outside Colombia?
The account statement and the certification are requested from the utility and in several cases handled online. Where the request has to come from the owner, the seller files it and you receive the document in writing.
