Handover is the one moment when the buyer has the property in front of him and still holds something to pay or to demand. Whatever is left out of the acta that day stops being a claim and becomes a conversation.
Taking delivery of a dúplex (two-level unit) is not signing that the keys arrived: it is recording the condition in which the property is received, the open items, and how and when they will be addressed. The acta de entrega is a private document between the parties, and its worth lies in its detail: an inventory of what is handed over, meter readings, the state of finishes and equipment, keys and remotes, and the list of observations signed by both sides. New construction adds the recibo de obra and whatever the builder has warranted; a resale adds whatever the seller undertook in the promesa de compraventa, the binding promise of sale. After handover the claim changes counterpart: it stops being a conversation with a seller or a builder and becomes a contractual matter, which is where it starts to matter whether there are proceedings open against the person who sold to you.
A dúplex is bought differently because what you see and what is recorded may not be the same thing. Two levels joined by an internal staircase are lived in as one home, yet the registry may still see two: two matrículas inmobiliarias (registry folios), two ownership shares, two chains of title and two separate arrears accounts with the building. That gap between the physical thing and the legal thing organizes the entire purchase. If there are two folios, you are really signing two acquisitions that end up tied in fact but not in law, and each one can be taxed, mortgaged, attached and sold on its own, so a future buyer may find half a home on offer. If there is a single folio, you need to know when and how the merger happened, because joining units is an amendment to the reglamento and not merely building work. What gets examined here, then, is the identity of the property before its condition: how the unit came into being, which document recognizes it, and whether the copropiedad was ever told. For a buyer abroad, each folio may also carry its own paperwork and its own power of attorney.
Here the file is complicated by a neighbor nobody negotiates with: the air terminal. The neighborhood sits under the approach path, so a building project is not reviewed only by the curaduría urbana, the private office that grants permits, but also by the civil aviation authority, which sets the obstacle limitation surfaces, and by the operator running the airport under concession. That reorders the procedure: before buying with any plan to add height, request the land-use opinion from the District and ask about the aviation ruling, because that is where a seller's assumptions collapse. On top of height there is noise exposure, which never appears on the certificado de tradición y libertad, the registry history and encumbrance certificate, and does appear in the airfield regime, so the exposure sits in the rules over the land rather than in the title itself. The counterparty differs too: a formal neighborhood of long-standing owners, with unsettled sucesiones, estate proceedings, and houses carved into several apartments without registering the split, so compare the original permit against what stands before accepting a per-unit valuation.
What is specific to Crespo
The neighborhood you cross to enter or leave the city: residential, fully built out and pressed against the air terminal, with its own seafront. Family houses and residential buildings sit alongside apartments used for short stays because of how close the terminal is. It is the hinge between downtown and the Zona Norte: the exit to the Anillo Vial and the way into Rafael Núñez airport both run through it.
- what building height the lot allows under the airport approach path, because the aviation restriction stacks on top of District zoning and is the first fact left out when a lot is offered
- whether what stands matches the permit and the registry folio, a common gap in family houses split into apartments without registering the split
- how shoreline protection in front of the property was resolved and which body answers for that work, because it is not the seller
What to verify, step by step
- Ask for the acta template before the appointment and read it with your lawyer: anything without a field will not get written down.
- Walk the property with the permit and the approved drawings in hand and compare what was built against what the curaduría authorised.
- Put meter readings, the inventory of keys and remotes, and every observation with the open item it creates in writing.
- Check the handover points that belong to dúplex units: whether both levels sit on a single matrícula inmobiliaria (registry folio) or on two, since that decides whether it conveys as one property or as two; whether the internal staircase appears on the plans approved with the licencia de construcción or was cut later to join two units and how the coeficiente de copropiedad was restated after the merger, because if the reglamento was never amended the dues may still be billed twice.
- Add what has to be verified in Crespo: what building height the lot allows under the airport approach path, because the aviation restriction stacks on top of District zoning and is the first fact left out when a lot is offered; whether what stands matches the permit and the registry folio, a common gap in family houses split into apartments without registering the split and how shoreline protection in front of the property was resolved and which body answers for that work, because it is not the seller.
- If you cannot attend, grant a power of attorney to someone who receives on your behalf, and require the signed acta plus photographs and video of the walkthrough the same day.
Mistakes that cost money
- Signing the acta with no observations so as not to delay handover. It is the most expensive waiver in the process, and it is made out of politeness.
- Taking delivery without clearance certificates for dues and utilities. The unpaid account follows the property, not the seller who left.
- Leaving an open item in a WhatsApp message. The acta gets signed; the message gets deleted.
Frequently asked questions
- Can I take delivery of a dúplex (two-level unit) without travelling to Cartagena?
- Yes, with a power of attorney granted before a Colombian consul or apostilled. Whoever receives should be someone technical, not the same broker who sold it.
- Who do I claim from after handover?
- It depends on what was signed: the builder for what was warranted, the seller for what was promised, and the administración for anything that is common property. That is why the acta is drafted with names in it.
- Is video of the walkthrough worth anything?
- It backs up what was written in the acta. It does not replace it: the signed document is what binds.
